A casual employee engaged has no guaranteed hours of work, usually works irregular hours (but can work regular hours), does not get paid sick or annual leave and employment can be terminated without notice, unless notice is required by a registered agreement, award of employment agreement. Effective 1 January 2018 casual employees have been given entitlement to overtime under certain awards as follows:
Hospitality Award
Casual employees now have an entitlement to overtime pay. They get overtime when working:
- more than 38 hours per week, or an average of 38 hours per week over a roster cycle (which may not exceed 4 weeks)
- more than 12 hours per day
Registered Clubs Award and Restaurant Award
Casual employees now have an entitlement to overtime pay. They get overtime when working:
- more than 38 hours per week, or an average of 38 hours per week over a roster cycle (which may not exceed 4 weeks)
- more than 12 hours per day or shift
Casuals may also be entitled to a meal allowance when working overtime
Retail Award
Casual employees now have an entitlement to overtime pay. They get overtime when working:
- more than 38 hours per week, or an average of 38 hours per week over a roster cycle
- outside of the span of ordinary hours
- more than 11 hours on one day of the week, and more than 9 hours on any other day of the week
Few other awards where entitlements to overtime have changed to casual employees are as under:
- Fast Food Award
- Hair and Beauty Award
- Passenger Vehicle Award
- Pastoral Award
- Rail Award
- Social and Community Services Award
- Wine Award
